What are the Types of Divorce in Turkey?
In Turkey, divorce may occur in two ways in practice: "Uncontested Divorce" and "Contested Divorce". For a finalization of uncontested divorce, the parties must agree on divorce and make a Divorcing Protocol. "If the Judge finds that this agreement is eligible", the divorce will be approved. Because of this reason, it is important that the content of the protocol must be prepared eligible with the law. Getting a professional legal service will help you in advance in the process more effectively.
As for contested divorce, the court examines whether the reasons listed in Turkish Civil Code has been fulfilled or not. Here, it is very important that the litigation is filed with the correct reason and basis. Otherwise, if the litigation is rejected, it is not allowed to file again within three years. In addition, active tracking of forthcoming situations such as alimony and custody matters during the litigation process and good communication between client and lawyer are other important things.
As Coşkunüzer Law Firm, we support our clients by providing professional legal services in all processes of divorce litigations.
How to Change Your Name in Turkey?
According to the regulations within the scope of the Population Services Code, persons have the freedom that allows them to change their names or surnames that conflict with the Surname Law or that violate the general rules of morality or that contain humiliating expressions. As a new practice, it is currently possible to apply for a name change through e-Devlet without going to the Population Registry Offices. Nevertheless, the name change request must be justified and based on legally valid reasons. The burden of proof about this request is on the person requesting a name change or surname change.
However, this regulation exists only in terms of names that are contrary to public morals or humiliating. Apart from this, the request for change of name or surname must be carried out through litigation. The Turkish Civil Code regulates matters within the scope of the material and moral integrity of persons. "Individual Name of the Person" is also included in this scope. According to the Code, in the presence of valid reasons, the names of persons can be changed by court decision. You can get support from our company for the filing and pursuing of this litigation.
