What is Commercial Litigation?
These are litigations related to commercial disputes that are examined by the Turkish Commercial Court. Their names are "Definitive Commercial Litigation" and "Relative Commercial Litigation". Definitive commercial litigation is the litigation listed in Article 4 of the Turkish Commercial Code, regardless of whether the parties are merchants or not. Relative commercial litigation will occur if the parties are merchants or if the dispute is related to a commercial enterprise. In practice, the Court does not consider this distinction. However, the fact that the litigation is filed to the competent and authorized court is an important issue for Turkish Commercial Law and requires the support of qualified lawyers who have experience in this field.
Merchant and Commercial Transaction Based on Commercial Law
The Code defines the “merchant” as a person who actually operates a commercial enterprise on his/her own behalf. In addition, the person who notifies via public announcements that he/she has established a commercial enterprise, even if he/she has not yet started commercial activity, and the person who announces that he/she has registered his/her enterprise with the Commercial Records will also be considered as a merchant according to the Turkish Commercial Code. Activities related to the subjects regulated under the Turkish Commercial Code or all transactions concerning a commercial enterprise are defined as “commercial transactions” under the Code. The merchant or company partner has several responsibilities about commercial transactions caused by being a merchant.
