Turkish Civil Code defines that there are three types of wills: "Notarial Testament", "Oral Testament" and "Handwritten Testament". A handwritten testament is a will prepared by a person in his/her own handwriting by complying with certain conditions mentioned in The Code such as date and signature. However, due to absence of official protection, these testaments may be damaged or destroyed. This may result to various losses of claims or properties. Oral testament can only be executed in force majeure such as imminent danger of death, disconnection of transportation, illness, war, etc. where the inheritor is unable to make notarial or handwritten testament. Therefore, this type of testament cannot be always used; it is an extraordinary form of testament.
Official testaments are wills prepared or approved before a notary. It is important that the provisions of these testaments comply with due form. At this point, it is necessary to obtain a professional legal service during the preparation and notarization procedures of the testament.
