Arrest and Detention
Article 100 of the Turkish Criminal Procedure Code underlines that an arrest warrant may be given if there is one of the reasons for arrest and tangible evidence indicating the existence of strong suspicion of a criminal offense. An arrest warrant must be given by the criminal judge. It is possible to oppose to the arrest decision. For a person who is under an arrest warrant, objection to the arrest decision is a very essential criminal law procedure.
Detention is also regulated under Article 91 of the Turkish Criminal Procedure Code. Detention warrant is usually given after an actual arrest of the suspect. To impose detention warrant needs the obligation in terms of the investigation and the existence of concrete evidence indicating the suspicion that the suspect has committed a crime. A court decision is not required for issuing the detention warrant; it can be ruled by the Turkish Public Prosecutor or Enforcement Officers. It is also possible to oppose to the detention warrant.
Anyone who has been subjected to wrongful arrest or wrongful detention may apply for a compensation litigation.
Deferment of the Announcement of the Verdict
This is the 5-year-suspension of the verdict given by the court. If the person does not commit any crime within this period, the punishment because of this decision is removed. However, if any crime is committed during this period, the person will be punished both crimes which are the subject of the first crime and the second crime he/she has committed.
